A. Cancellation Policy
Introduction
Consumers have a right of cancellation in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity:
Right of Cancellation
You have the right to cancel this contract within 90 days without giving any reason.
The cancellation period is 90 days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (Pathway Motion, Werner-Heisenberg Straße 14, 34123 Kassel, Germany, Tel.: +49 561 9893713, Email: shop@pathwaymotion.com) of your decision to withdraw from this contract by means of an unequivocal statement (email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you (excluding delivery costs) without undue delay and no later than 14 days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 90 days has expired.
You bear the direct costs of returning the goods, and there are no restocking fees.
You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
The right of withdrawal does not apply to consumers who are not citizens of a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.
Damage or Wrong Product
If you receive a damaged or wrong product, please reach out to us via our email with picture and video evidence of the issue. Pathway Motion will bear the cost of return and shipping replacements.
Exchange
Pathway Motion offers exchange on all our products. You can exchange products in good condition for a different size or color. The customer will bear the cost of returning and shipping the products.
General information
1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us freight collect.
3) Please note that the aforementioned points 1-2 are not prerequisites for the effective exercise of your right of withdrawal.
